    The Faces of Gaming Monthly Video Contest Rules

    OFFICIAL RULES

    No purchase necessary to enter or win. Must be 18 years of age or older to enter. Rules are subject to change without notice.

    The Faces of Gaming Monthly Video Contest (“Contest”) offered by the American Gaming Association (“Sponsor”) is designed to promote the positive effect of gaming on the careers and lives of people whose job depends on the gaming industry.

    1. CONTEST DATES: The Contest begins at 12:00 a.m. E.T. on February 12, 2015 and ends on at 11:59 p.m. E.T. November 30, 2016 (“Entry Deadline”). The deadline for each month’s contest is 11:59 p.m. E.T. on the last day of the month.

    2. HOW TO ENTER:

    a) Create an original video of no more than two (2) minutes in length answering the question, “Tell us what gaming means to you – and why you deserve to be featured as the ‘Face of Gaming’?” The video must describe your work in the gaming industry and the positive impacts on your career and/or life (“Video” or “Video Submission”);

    b) Login to www.FacesofGaming.org/contest (“ Contest Website”) by providing all requested information (including, name, email address, city/zip code, company, job title and video URL);

    c) Upload your video to the Contest Website’s video wall by the Entry Deadline in one the following formats: YouTube, Vimeo, Facebook, Instagram, Vine, and Twitter. Videos must be under 150 MB. Videos submitted in other formats and/or that exceed the size and time limits will be disqualified. All videos must comply with the terms of service and specifications for user contests and sweepstakes, submissions and/or video uploads of the video format you choose, located at: http://www.youtube.com/t/terms for YouTube; http://vimeo.com/terms for Vimeo; https://www.facebook.com/legal/terms for Facebook; http://instagram.com/about/legal/terms/# for Instagram; https://vine.co/terms for Vine; and https://support.twitter.com/articles/18311-the-twitter-rules# for Twitter. In addition, all videos must comply with any additional terms of service or specifications for submissions and/or video uploads as may otherwise be posted on the Contest Website. Videos that do not comply with these rules will be disqualified and deleted. Video Submissions may be featured on the Contest Website at www.FacesofGaming.org at Sponsor’s sole discretion.

    3. ELIGIBILITY: Contest is open to individuals 18 years of age or older who are legal residents of the United States or Puerto Rico and who are currently employed or were formerly employed at a commercial or tribal casino or a manufacturer or other supplier to a commercial or tribal casino (“Entrant”). Void outside of the United States, Puerto Rico, and where prohibited. Employees, officers and directors of Sponsor, members of their immediate families, and those living in the same household, are ineligible to participate or win. Entrant must have a valid email address to log in and upload the Video. Entrants may enter multiple Videos in the Contest, provided that each Video is a unique submission. Duplicate entries will be deleted. Entry constitutes Entrant’s certification that he/she (i) meets the eligibility requirements, (ii) has read these Official Rules and agrees to comply with their terms, and (iii) has read and consents to Sponsor Privacy Policy (as defined in Section 8 below). Sponsor reserves the right to verify eligibility of any potential winner. Winning a prize is contingent upon fulfilling all requirements set forth herein. Entrants are required to provide truthful information. Sponsor will disqualify any entry that does not meet the eligibility requirements and will also delete any entry as required by law.

    4. PRIZES AND JUDGING

    a) Prizes: Prizes will be awarded monthly. There will be a total of 22 prizes during the Contest period. One Entrant each month will win a $100 (USD) gift card (each, a “Monthly Winner”). Allow four weeks following the notification and announcement described in Section 5 for delivery of prizes.

    b) Judging: Monthly Winners will be selected from the Video Submissions by a panel of judges selected by Sponsor. The panel of judges will be selected by Sponsor in its sole discretion. In the case of a tie, Sponsor, at its sole discretion, will either select the Monthly Winner or request that the public vote on the Monthly Winner using Sponsor’s social media channels. Judging will occur within 15 days after the first day of each month for videos submitted during the previous month. The Videos Submissions will be judged based on the following criteria:

    • Originality and creativity of the story in the video
    • Effectiveness and clarity of communication and mode of presentation
    • Thoughtfulness of concept
    • Energy and level of engagement

    c) Prize Restrictions: Monthly Winners may not assign or transfer the prize to other persons. No prize substitution or changes are allowed except at the discretion of Sponsor. Prize cannot be redeemed for cash. Prize is subject to availability. If the prize is awarded but unclaimed/forfeited by recipient, the prize may not be re-awarded in Sponsor’s sole discretion. Other restrictions may apply.

    5. WINNER NOTIFICATION AND ANNOUNCEMENT: Monthly Winners will be notified by email (via the email account used to register on the Contest Website) by the end of the month for Video Submissions made during the prior month. Each Monthly Winner must execute and return any required affidavit of eligibility and release, and publicity release within ten (10) days of the notification attempt or that Monthly Winner will be disqualified and the prize will be forfeited to an alternate Monthly Winner chosen from the Video Submissions based on the criteria listed in Section 4.

    6. RESTRICTIONS: Entries that contain prohibited material described below or otherwise violate these restrictions will be disqualified and the Video Submission may be deleted. Inclusion of the following material in the Video Submissions is prohibited:

    a) Material which is (or promotes activities which are) sexually explicit, obscene, pornographic, violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing are strictly prohibited;

    b) Material that is unlawful, in violation of or contrary to the laws or regulations of the jurisdiction in which the Video Submission was created;

    c) Copyrighted media production including but not limited to music, films, books, television programming, etc., or identifying descriptions of any media production;

    d) Material that violates or infringes another’s rights, including but not limited to material that violates privacy, publicity or intellectual property rights, or that constitutes copyright infringement. Without limiting the foregoing, Video Submissions must not include third party trademarks, logos, insignia, location signage, photographs, artwork, or sculptures. Use music that isn’t originally written, performed and produced by you, the Entrant. All music featured in any video must be available to publicize and broadcast on a licensefree, no compensation basis;

    e) Depiction of individuals, including but not limited to minors, celebrities and friends who have not expressly authorized Entrants to display their image, likeness or voice in any submitted video or otherwise use such image, likeness or voice in accordance with these Official Rules; and

    f) Material that contains any viruses, spyware, malware or other malicious components that are designed to harm the functionality of a computer in any way.

    7. CONDITIONS

    a) Participating in the Contest and acceptance of a prize constitutes a Monthly Winner’s permission for Sponsor or its agents to photograph, film and record each Monthly Winner, and to use his/her Video Submission, name, address (city and state), likeness, photograph, voice, biographical information and/or any statements made by him/her regarding the Contest or its sponsors for purposes of trade, publicity or promotion without additional financial or other compensation, and, Sponsor may, where legal, require a Monthly Winner to sign a publicity release confirming such consent prior to acceptance of the prize.

    b) By participating in the Contest, you:

    i) Agree to grant Sponsor a non-exclusive, perpetual, worldwide license to edit, telecast, exhibit, rerun, reproduce, use, syndicate, license, print, distribute and otherwise exploit the Video Submission(s), audio, or other material submitted as part of your contest entry (the “Materials”), or any portion thereof, in any manner and in any and all formats and media now known or hereafter devised, without payment to you or any third party;

    ii) Acknowledge that Sponsor reserves the right, in its sole discretion, not to use the Materials at all;

    iii) Understand and acknowledge that Sponsor has wide access to ideas, stories, designs, and other literary materials, and that new ideas are constantly being submitted to it or being developed by their own employees. Each Entrant also acknowledges that many ideas or stories may be competitive with, similar or identical to the Materials and/or each other in theme, idea, plot, format or other respects. Each Entrant acknowledges and agrees that such Entrant will not be entitled to any compensation as a result of Sponsor’s use of any such similar or identical material. Each Entrant acknowledges and agrees that Sponsor does not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the copyright in and to the Materials. Finally, each Entrant acknowledges that, with respect to any claim by Entrant relating to or arising out of Sponsor’s actual or alleged exploitation or use of any Materials submitted in connection with the Contest, the damage, if any, thereby caused to the applicable Entrant will not be irreparable or otherwise sufficient to entitle such Entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition or other exploitation of the Video or any other production based on or allegedly based on the Materials, and the Entrant’s rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law; and

    iv) Represent and warrant that: you are 18 years of age or older; you have the full legal right, power and authority to grant to Sponsor the license provided for herein; you own or control the complete exhibition and other rights to the Materials you submitted for the purposes contemplated in this license; you are either the parent (or legal guardian) of any minor featured in the Materials or have received the express consent of the parent (or legal guardian) for any such minor to appear in the Materials and to enter the minor’s likeness in the Materials in the contest; and neither the Materials nor the exercise of the rights granted herein shall infringe upon or violate the right of privacy or right of publicity of, or constitute a libel or slander against, or violate any common law or any other right of, any person or entity.

    c) Prior to awarding any prize, and depending on the nature of the prize and eligibility requirements of the Contest, Sponsor in its sole discretion may require verification of a Monthly Winner’s identification by a showing of valid government-issued photo identification. By participating and/or accepting a prize, entrants, each Monthly Winner agrees to release and hold harmless Sponsor, its sponsor(s) and promotional partner(s), its advertising and promotion agencies, and each of their respective parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents, representatives, successors, and assigns of each of them (collectively, the “Released Parties”) against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest. Sponsor may also require eligible Monthly Winners to sign a liability release confirming such consent.

    d) Sponsor, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Contest if he or she tampers with the entry process, the operation of the Contest, or the operation of Sponsor’s Contest Website, Facebook Page, and/or any other social networking site used in the Contest, or is otherwise in violation of the rules. Sponsor further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Contest, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond Sponsor’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest as determined by Sponsor in is sole discretion. Any attempt by an entrant or any person to deliberately damage any Sponsor Contest Website, Facebook Page, and/or any other social networking site used in the Contest or to undermine the legitimate operation of this Contest may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstances beyond the control of Sponsor, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, Sponsor reserves the right, but not the obligation, to modify, terminate, suspend or cancel the Contest and shall not be required to award a substitute prize.

    e) The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals, or any other difficulties that may prevent an individual from sending or receiving a text message; or (iii) lost, stolen, mangled, misdirected, postage due, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of a Contest prize that cannot be awarded due to acts of god, acts of war, natural disasters, weather, acts of terrorism or other factors beyond Sponsor’s control.

    f) To the fullest extent permitted by law, by participating in the Contest, you understand and agree that:

    i) Any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action;

    ii) If the parties are unable to resolve their dispute amicably, it shall be resolved by means of binding arbitration (not in a court of law);

    iii) Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event and under no circumstances will entrants or winners be permitted to obtain awards for attorneys’ fees, and you hereby waive all rights to claim punitive, incidental, or consequential damages, or any other form of damages, other than actual out-of pocket expenses, and any and all rights to have damages multiplied or otherwise increased; and

    iv) Any claim or dispute regarding the Contest or these Official Rules will be resolved pursuant to the laws of the District of Columbia, without regard to conflict of law principles, and you submit to the jurisdiction of the courts within the District of Columbia and waive all objections to the jurisdiction or venue of such courts.

    g) The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.

    8. PRIVACY POLICY: Any personal information supplied by you to Sponsor will be subject to Sponsor’s privacy policy posted at http://www.americangaming.org/privacy-policy (“Privacy Policy”). By entering the Contest, you grant Sponsor permission to share your email address and any other personally identifiable information with any co-sponsorsolely for the purpose of administration and prize fulfillment. Sponsor will not sell, rent, transfer or otherwise disclose your personal data to any third party other than as described above herein or in the privacy policy.
