Supporting the Legal Sports Betting Market
Since the federal ban was overturned in 2018, states and sovereign tribal nations have had the opportunity to establish frameworks for legal sports betting, which protect consumers and create tax benefits for local communities.
Embracing America’s Passion Through Effective Regulation
In May 2018, the U.S. Supreme Court struck down the Professional and Amateur Sports Protection Act (PASPA), a decades-old federal law that prevented states other than Nevada from allowing legal, regulated wagers on collegiate and professional sports. This federal prohibition inadvertently created a massive illegal market — along with a myriad of associated public policy problems.
The Supreme Court’s 7-2 decision was a win for millions of Americans who seek to participate in sports wagering in a safe, legal and regulated manner. States and tribal nations can now set their own policies to legalize and regulate sports betting in an effective manner that protects consumers and creates tax benefits for local communities.
Since May 2018, sports betting is legal in 38 states and Washington, D.C., and has generated more than $2.45 billion in federal, state and local taxes.* This tax revenue funds infrastructure, education, responsible gaming education, problem gambling services, and other core priorities.

Repealing Federal Excise Tax on Sports Betting
The Internal Revenue Code currently imposes a federal excise tax of 0.25 percent on the amount of any legal sports wager with a sportsbook, as well as an additional $50 annual head tax for every employee engaged in receiving wagers for or on behalf of any legal sports betting operator. This tax was established in the 1950s, not as a revenue source, but rather as a tool for prosecuting illegal bookmaking operations that didn’t pay the tax.
Currently, this tax serves no dedicated purpose and represents an added operating cost to legal sportsbooks that illegal operators do not pay, further impeding customers’ move away from the predatory, illegal market to safe, regulated sports betting channels. Congress can help empower the success of a safe, regulated marketplace by repealing the federal excise tax that unnecessarily disadvantages legal sports betting operations.

Sizing the Illegal and Unregulated Gaming Markets in the U.S.
The legal gaming industry is among the most highly regulated industries in America. AGA estimates that Americans bet more than $673.6 billion a year with illegal and unregulated operators. Driven by a sharp rise in illegal iGaming, expanding use of unregulated skill machines, and persistent illegal sports betting, the illegal market has grown 22% since the AGA’s last report in 2022.
Illegal operators exploit communities without contributing to them—providing no consumer protections, no responsible gaming programs, and no economic return to the states where they operate.

In a letter to the U.S. Attorney General, the AGA outlines the pervasive nature of illegal gambling and the threat these unregulated operators pose to consumers, state economies and the legal gaming industry as part of the association’s ongoing initiative to stamp out the illegal market.

For decades, regulated sportsbooks in Nevada offered the only legal sports betting in the U.S. However, with the advent of the internet, illegal bookies have taken advantage of lax or even non-existent laws in other countries to set up online sportsbooks that target American customers. These illegal sportsbooks prey on unsuspecting Americans, despite claims of regulation and licensure in their home countries.

The robust licensing and operational standards for all gaming companies are essential to the casino gaming industry’s success. Unfortunately, unregulated and illegal gaming machines continue to proliferate across the country and threaten the economic benefits and consumer protections provided by the regulated industry.

National Economic Impact of the U.S. Gaming Industry 2023
The gaming industry remains a powerful economic engine and a dynamic job creator.
The gaming industry has an expansive impact on the US economy – providing stable jobs to nearly two million Americans and generating billions of dollars in tax revenue. This research represents the first comprehensive report on the gaming industry’s national economic impact since 2018.
The gaming industry supports a total economic impact including:
- $329 billion of output (business sales)
- 1.8 million jobs with $104 billion of labor income (wages, salaries, tips, benefits and other labor income)
- $53 billion of federal, state and local taxes, including $13.5 billion of gaming taxes
The gaming industry directly employs more than 700,000 people in the US This includes nearly 600,000 on-site jobs at casinos and corporate offices, more than 23,000 at US-based operations of gaming manufacturers, and 89,000 at businesses providing goods and services to casino patrons during casino trips.

The gaming industry directly employs more than 700,000 people in the U.S. This includes nearly 600,000 on-site jobs at casinos and corporate offices, more than 23,000 at US-based operations of gaming manufacturers, and 89,000 at businesses providing goods and services to casino patrons during casino trips.
The $53 million in taxes generated by the gaming industry provides critical funding for local public programs and services, including education, infrastructure and economic development, as well as supplemental revenue for state general funds.
According to the report, America’s gaming industry directly employs more than 700,000 people in the US Put in context with the broader US economy:
- Gaming provides more direct jobs than the air transportation, postal service or motion picture and video sectors.
- Direct casino employment accounts for 1 in 33 leisure and hospitality jobs.
Recent, related AGA research shows the economic benefits generated by gaming are widely recognized by Americans, with a record 71 percent of adults saying the casino gaming industry has a positive impact on the US economy.

By educating employees and guests about its most common indicators, and by working with law enforcement and other partners, casinos can and will make an impact in eradicating this form of modern-day slavery.
The AGA Anti-Human Trafficking Task force is comprised of member representatives with expertise in security, hospitality, anti-money laundering compliance, legal and other specialized sectors of our industry.
Free Anti-Human Trafficking Training
In partnership with RG24seven, the AGA launched a first-of-its-kind training to educate gaming industry employees on how to combat human trafficking.
Available to all gaming companies, the free training is based on AGA’s Guide to Preventing and Combating Human Trafficking and draws on expertise from AGA’s Anti-Human Trafficking Task Force, nonprofits and law enforcement.
The training uses videos, quizzes and expert voices to educate participants, who will receive a verified certificate upon successful completion. The training has specific modules for front of the house, AML compliance professionals, and tribal gaming employees. Traffickers take advantage of legitimate industries and supply chains to find, exploit and traffic victims. This is especially true for the travel and tourism industry—including casino gaming. Human trafficking may be linked to other illegal enterprises such as narcotics or firearm trafficking, terrorist organizations and money laundering.
